Smith McDonald expressed disappointment that San Jose State’s student-athletes, who are fully compliant with NCAA and Mountain West rules and regulations, are being denied opportunities to compete. The university remains committed to supporting its student-athletes and providing an inclusive, fair, safe, and respectful environment.

An anonymous parent at San Jose State claimed there were rumors about a transgender athlete, sparking the controversy. Riley Gaines and Brooke Slusser are among the students involved in the lawsuit. Slusser, who joined the lawsuit in late 2023, stated that the transgender athlete personally informed her about their identity, and she refused to use their preferred pronouns. Slusser claims to have suffered physical and emotional injuries, embarrassment, humiliation, distress, and mental anguish from participating on a team with a transgender student.
